When is a theft, not a theft….

Well I can honestly say, you learn something new every day.

Scenario, you rent your house out via Bookings.com and that person invites his brother to visit. His brother (underage known car thief) sees your car keys, steals them, and subsequently steals the car. He then goes on a rampage damaging your car, which is later found by the police.

So my question is, is this theft of a motor vehicle?

Yes, of course it is theft of a motor vehicle I hear you say, and of course you’re right. However, in the insurance world, its not. Why? Because you have to do due diligence to protect your property. If not, there is a clause in ALL Spanish insurance policies that allows them not to pay out.

This also applies if you let someone visit you for a drink or a meal. It doesn’t just have to be that the house is rented out.

It has to be said that this is a rare occupancy and the first time I have come across it in 10 years of being involved with Spanish insurance

We are now fighting to get compensation for our client. I am sure we will get something, but maybe not the full amount.
